In the case in which a customer wishes to place an on-line order of one or more of the products offered on the website :www.optical-center.eu., there is no need for a handwritten signature of the document.

The customer has the right to save or edit the present general conditions. The editing or saving of the general purchasing conditions is entirely the customer’s responsibility. All products purchased from this website are intended for the personal use of the customer and must not be used for any kind of direct professional activity.

Their purpose is to define, the rights and obligations of each party (i.e., the company www.optical-center.eu and its on-line customers), concerning the on-line sales of the suggested products on the website: www.optical-center.eu with the exclusion of all other documents.

2. Description of activity

The company « Optical Center Sarl » operates on-line under the address : www.optical-center.eu ( called hereinafter « Optical Center Sarl / www.optical-center.eu »).Optical Center Sarl / www.optical-center.eu has as its sole objective long distance sales on-line of contact-lenses and other care products for contact lens.

3. Contract Confirmation

The confirmation of the contract takes place as soon as the customer clicks on the order button, while keeping in mind the general sales and delivery conditions. Once the customer has placed his order and has paid for it, he will receive a confirmation e-mail of his order. By placing an order the customer confirms that he is only renewing an existing prescription of contact-lenses recommended and suited to his eyesight by his ophthalmologist. Optical Center Sarl / www.optical-center.eu do not offer an initial nor personal fitting of new contact-lenses. By placing an order the customer further confirms that he is 18 years and older and has regular check-ups by his doctor/ophthalmologist no less than every six months.( see also condition 8. Responsibility, Damage and Interest)

4. Prices

The indicated product prices are in Euros and include the TVA calculated according to the order date. The products will be invoiced according to the indicated prices on the website at the time of the order. The prices do not include shipping costs which will be added and specified in the confirmation e-mail once the order has been placed. A detailed receipt will appear in the invoice included in the package.

Optical Center Sarl / www.optical-center.eu reserves the right, which the customer agrees to, to modify its prices at any given time, however the products ordered will be calculated according to the prices on the site the day of the order depending nevertheless on the availability of those particular products. The price list in effect is the one indicated on the site www.optical-center.eu, except for misprints or posting errors. All orders must be paid for in Euros.

5. Payment Conditions / Delivery.

Optical Center Sarl / www.optical-center.eu delivers only within the European Union countries, defined as such at the time of the order. The payment must be by credit card after receiving the invoice e-mail which includes shipping and delivery fees according to the designated country. As soon as the package arrives, the customer must check the package in order to insure that all its contents are in tact. If the customer finds the goods damaged he must refuse to accept the package and must immediately notify the shipping company. In order for Optical Center Sarl / www.optical-center.eu to take responsibility for damaged goods the package must remain sealed and un-opened by the client on the inside (excluding packages and contact lens boxes having arrived opened). The general shipping time is between one and three weeks.

A specific shipping date can not be guarantied by Optical Center Sarl / www.optical-center.eu since the possible shipping delays depend on the manufacturer in the same way as the « force Majeur » case. Therefore potential delays do not constitute the right for a legal cancellation of the contract.

Optical Center Sarl / www.optical-center.eu will endeavor to deliver the merchandise within 48 hours from the time it’s been received from the manufacturer. The goods remain the property of Center Sarl / www.optical-center.eu until full payment has been received.

6. Exchange and Return policies

Optical Center Sarl / www.optical-center.eu ‘s general policy allows exchanges and returns of products within 14 days of the customer’s package receipt. This term applies only for goods returned to the shipper in their original packaging, intact and suitable for resale.

Packages or boxes of contacts which have already been opened as well as special orders (such as multiple lens, toric lens etc…) are not returnable or exchangeable, except in the case in which there is a manufacturing defect. In such cases the returned package must be accompanied by a letter with the client’s name and address plus a short explanation of the reason for return and a copy of the invoice.

In the case of reimbursement the customer’s bank-card will be credited. However, in order to do so, the customer must send all his bank information (name of the bank, IBAN number, BIC /swift code).

The customer is explicitly informed that Optical Center Sarl / www.optical-center.eu are not the manufacturer of the products sold on line at www.optical-center.eu.
Therefore, if any sort of defect is found in one or more of the products, the customer must submit the product to its manufacturer according to the details of each specific product found on the back of the package.

7. Product Availability

All the products on the site are limited according to available stock. In the case in which one of the products is out of stock, the customer will immediately be informed of the delay in the order. If the product has not come back into stock within a month, Optical Center Sarl / www.optical-center.eu will inform the client and offer him a full reimbursement under the conditions mentioned in clause 6. « Exchange and Return policies ».

8. Responsibility and damage rights

The customer exempts Center Sarl / www.optical-center.eu of all responsibility in the case of health deterioration possibly caused by the usage of contact lenses or solutions purchased through this web-site. All contact must be cleaned and kept according to the instructions of one’s ophthalmologist /optometrist and the instructions of the product.

The amount of time recommended for use and the expiration dates must be strictly obeyed. As soon as any kind of symptom such as: irritation or redness in the eyes, deterioration of ones sight and any other discomfort is felt, contacts must be removed and one must consult his ophthalmologist immediately. Damaged or defective contact lens should not be used under any circumstances. The customer must only order contacts which have been prescribed to him by his ophthalmologist and which he’s already tried and had no trouble with before.

Damage caused by the use of unsuitable contacts chosen by the customer himself on the site without having had a professional consultation beforehand is not subsequent to recognition.

The rights to damages are limited to height of the value of the order. For the contents and the actualization of pages Internet put in bond and/or pages of possible affiliated partners, the respective owners of these pages Internet are exclusively responsible.

9. Privacy policy

The legal court is that of Luxembourg. The place of legal execution is at the company headquarters.
